Resumen : Los órganos jurisdiccionales juegan un papel esencial en el desarrollo de la justicia alternativa, sin que ello implique subordinación ni dependencia al Poder Judicial. Lo importante son las relaciones entre estos dos sistemas el heterocompositivo (proceso) y el autocompositivo (mediación y conciliación) para cumplir mejor su tarea de resolución de conflictos derivados de la interacción social. En opinión nuestra la justicia alternativa por sus propias características no debe mantenerse alejada de la jurisdicción, empero, tampoco incrustada en ella. Por ello, nuestro interés estriba en aportar una visión diferente de la justicia alternativa, no sólo en la doctrina sino a fin de impactar en una mejor regulación de la justicia alternativa en la ley local que la contiene, propiciando su eficacia práctica, finalidad última de la presente investigación.
Descripción : The courts play an essential role in the development of alternative justice, without involving subordination and dependence on the judiciary. What is important is the relationship between these two systems the heterocompositive (due processo f law) and autocompositive (mediation and conciliation) to better fulfill its task of settling disputes arising from social interaction. In our opinion the alternative justice by its very nature must not stay away from the jurisdiction, however, not embedded in it. Therefore, our interest lies in providing a different view of the alternative justice, not only in doctrine but in order to impact better regulation of alternative justice in local law that contains it, promoting their practical effectiveness, ultimate purpose of the present investigation.
