| Resumen : | A modo de justificación del tema, se tiene el análisis a las reformas del 17 de abril de 2013, a los artículos 268, 403, 409 y 439 del Código Civil del Estado de Nayarit, en el que se adicionan respecto de la manipulación que realiza uno de los progenitores al hijo o hijos, para que odie o se aleje del otro progenitor. El planteamiento del problema radica, en que si bien conforme lo establecido en el artículo 4°de la Constitución Política Mexicana y 3° de la Convención Sobre los Derechos de los Niños, se debe tener en cuenta al bienestar del menor atendiendo al principio de interés superior del niño, por lo tanto, las reformas o actuaciones jurisdiccionales y administrativas, deben ser acordes a proteger al menor. |
